I acknowledge that participation in martial arts activities, including but not limited to karate training, sparring, drills, conditioning, and related activities, involves inherent risks. These risks include, but are not limited to, physical injury, illness, permanent disability, and death.
I voluntarily and knowingly assume all such risks, both known and unknown, even if arising from the negligence of Kaizen Dojo FL LLC, its owners, instructors, employees, agents, or affiliates.
To the fullest extent permitted by Florida law, I hereby release, waive, discharge, and covenant not to sue Kaizen Dojo FL LLC, its owners, instructors, employees, agents, and affiliates from any and all claims, liabilities, damages, demands, or causes of action arising out of or related to any injury, loss, or damage sustained while participating in any activities, whether caused by negligence or otherwise.
I agree to indemnify, defend, and hold harmless Kaizen Dojo FL LLC from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney’s fees) arising out of or related to participation in dojo activities.
I certify that the participant is physically fit to participate in martial arts activities and has no medical condition that would prevent safe participation. I agree to disclose any relevant medical conditions.
In the event of injury or emergency, I authorize Kaizen Dojo FL LLC to obtain medical treatment for the participant. I accept full financial responsibility for any medical care provided.
I understand and acknowledge that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Florida and that it includes a release of liability for the negligence of Kaizen Dojo FL LLC.
If the participant is under eighteen (18) years of age, I certify that I am the parent or legal guardian and have the legal authority to execute this Agreement on their behalf. I agree that this Agreement is binding on both myself and the minor participant.
If the participant is eighteen (18) years of age or older, I certify that I am legally competent to sign this Agreement on my own behalf.
I hereby grant and authorize Kaizen Dojo FL LLC the irrevocable and unrestricted right to photograph, record, and capture my or the participant’s image, likeness, voice, and/or performance (“Media”).
I grant Kaizen Dojo FL LLC a perpetual, worldwide, royalty-free right to use, reproduce, modify, distribute, display, and publish such Media for any lawful purpose, including marketing, advertising, social media, website content, and promotional materials.
I understand that no compensation will be provided for use of such Media and that all rights belong to Kaizen Dojo FL LLC. I waive any right to inspect or approve the final product and release Kaizen Dojo FL LLC from any claims related to the use of such Media.
I understand that enrollment at Kaizen Dojo FL LLC operates on a recurring membership basis. I agree to provide a minimum of thirty (30) days written notice to cancel membership. I understand that billing will continue during the 30-day notice period regardless of attendance.
I agree that no refunds, prorations, or credits will be issued for unused classes or partial billing periods unless required by law.
I understand that payments are due as scheduled and agree that a late fee of $25.00 may be applied to any past-due balance.
I authorize Kaizen Dojo FL LLC to charge my provided payment method for all applicable membership fees and charges in accordance with my membership.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
I have read this Agreement, fully understand its terms, and understand that I am giving up substantial legal rights, including the right to sue. I acknowledge that I am signing this Agreement freely and voluntarily.
